Ren\u00e9 Torres, Director General de CONTPAQi<\/a> comparte los pormenores que representa la reciente reforma al outsourcing en M\u00e9xico.<\/em><\/h5>\n

La reciente reforma a la subcontrataci\u00f3n en M\u00e9xico ha generado gran controversia en diversos grupos del sector privado. Apenas en abril pasado, las autoridades federales dieron a conocer que todas las empresas est\u00e1n obligadas a hacerse cargo, por completo, de la n\u00f3mina de su personal sin la intervenci\u00f3n de alguna firma de outsourcing, a fin de promover la transparencia en los pagos patronales y sus obligaciones fiscales.<\/p>\n

Este cambio a la ley tiene un inter\u00e9s claro por proteger los derechos de los trabajadores, pues busca eliminar viejas pr\u00e1cticas que atentaban contra su integridad laboral; sin embargo \u201cpagan justos por pecadores\u201d porque, parad\u00f3jicamente, esta modificaci\u00f3n dificulta la situaci\u00f3n de due\u00f1os de negocios que ahora deben enfrentar nuevos requerimientos y pagos con el objetivo de cumplir con esta reforma, al mismo tiempo de lograr solventar sus gastos y generar ganancias.<\/p>\n

La situaci\u00f3n complicada.<\/strong> Como muchos empresarios, estoy a favor de garantizar que nuestros colaboradores tengan todas las garant\u00edas de ley, las condiciones \u00f3ptimas para generar un patrimonio y contar con acceso al servicio de salud p\u00fablica. Las reformas que buscan mejorar la calidad de vida de los trabajadores no deber\u00edan ser una carga adicional para las compa\u00f1\u00edas en M\u00e9xico que, al final, generan empleos y bienestar para la sociedad.<\/p>\n

Otro dato de la necesidad del outsourcing<\/em>, con el fin de ganar flexibilidad, es la tendencia mundial, acelerada por la pandemia, por utilizar estos servicios: las condiciones de la econom\u00eda obligan a contratar y subcontratar personas para mantener su operaci\u00f3n dentro del mercado y acelerar su reactivaci\u00f3n.<\/p>\n

\u00bfCu\u00e1nto costar\u00e1 entonces este cambio para los empresarios?<\/strong> Diversas estimaciones calculan un promedio mensual de 15 mil pesos tan s\u00f3lo para cubrir el sueldo de una persona que lleve el control de la n\u00f3mina; a eso hay que agregar la compra de equipo tecnol\u00f3gico adecuado para llevar un control eficiente. Todo esto, por supuesto, afecta la estimaci\u00f3n del presupuesto que una empresa tiene.<\/p>\n

Habr\u00eda que agregar, tambi\u00e9n, que existe un profundo desconocimiento y confusi\u00f3n entre las PyMES<\/a> acerca de este tema; sobre todo, de lo que s\u00ed y no est\u00e1 permitido con esta reforma. Por ejemplo, con el tema de la \u201cespecializaci\u00f3n\u201d, las compa\u00f1\u00edas s\u00f3lo podr\u00e1n subcontratar a personal que trabaje en actividades que no coincidan con su objeto social. Desafortunadamente, a\u00fan existen este tipo de \u201clagunas\u201d de informaci\u00f3n que no permiten estandarizar criterios.<\/p>\n

Las empresas tecnol\u00f3gicas tenemos un gran dilema: En el desarrollo de software, muchas veces utilizamos el outsourcing para contar con el servicio de optimizaci\u00f3n y asesor\u00eda para un mejor funcionamiento de productos; o bien, establecemos alianzas de colaboraci\u00f3n con otras firmas digitales. Al parecer, con esta reforma, no podr\u00edamos contar con esos servicios ya que, al no contratar a nuestros aliados o colaboradores de proyecto, la estar\u00edamos incumpliendo.<\/p>\n

Otro reto que se presenta es hacer frente al desempleo. Como lo comentamos, la realidad financiera y econ\u00f3mica de las PyMEs<\/strong> las imposibilitar\u00e1 a cumplir a cabalidad con este cambio a la ley. Probablemente, muchas recurrir\u00e1n a la informalidad para contar con trabajadores en su operaci\u00f3n sin que reporten pago de sueldos antes las autoridades fiscales; lo que las vulnera, a su vez, a recibir alguna multa por no tenerlos registrados.<\/p>\n

Ya considerando la pr\u00f3rroga otorgada por el Congreso<\/strong>, las empresas del pa\u00eds deben migrar a m\u00e1s tardar el 1 de septiembre 2021, a los empleados subcontratados a la n\u00f3mina de su empresa. Desafortunadamente, esto anticipa que los \u00edndices de desempleo aumenten en los pr\u00f3ximos meses.<\/p>\n

Ante este panorama, la tecnolog\u00eda es una soluci\u00f3n l\u00f3gica para que las PyMEs<\/strong> puedan administrar la n\u00f3mina de sus colaboradores, de forma segura, eficiente y, sobre todo, con un costo operativo m\u00e1s bajo; sin embargo, hasta que no haya informaci\u00f3n m\u00e1s clara que detalle, puntualmente, los cambios de esta ley anticipamos problemas legales y de multas para muchas empresas en M\u00e9xico<\/p>\n

Con todo, habr\u00e1 que estar pendientes de los cambios que se anuncien con esta reforma al outsourcing, un tema por dem\u00e1s importante ya que ata\u00f1e a todas las empresas del pa\u00eds y, principalmente, a las peque\u00f1as y medianas; por ello, seg\u00fan se aplique, ser\u00e1 un factor relevante para el desarrollo econ\u00f3mico nacional.<\/p>\n
